1. Who we are
Semiotic Mapper (“we”, “us”, “our”, the “Service”) is operated by Anu Maarit Hoffman, an individual sole trader (the “Seller”). By using the Service you are entering into an agreement directly with the Seller.
2. Acceptance
By creating an account, subscribing, or otherwise continuing to use the Service, you confirm you have read, understood, and agreed to be bound by these Terms. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation.
3. The Service
Semiotic Mapper is a web application that lets users build semiotic squares and six-petal flower diagrams for brand strategy work, with AI-assisted suggestions for axes, competitors, blue oceans, tone of voice, and visual codes.
4. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- send spam or attempt to phish other users;
- infringe anyone's intellectual property, privacy, or other rights;
- upload malware, probe, scan, or otherwise interfere with security;
- scrape, crawl, or extract data in bulk without our permission;
- resell, sublicense, or redistribute the Service or its outputs as a competing product; or
- reverse engineer or attempt to circumvent technical limits, rate limits, or paid tiers.
5. AI-generated content
The Service uses third-party AI models to generate suggestions. You are responsible for the prompts you submit, for verifying the accuracy and suitability of outputs, and for ensuring you have rights to any content you input. Outputs may be inaccurate, incomplete, or biased and are not professional advice (legal, financial, medical, or otherwise). You must not use the Service to generate illegal content, deepfakes, hate speech, malware, or content that infringes anyone's rights, and you must not attempt to jailbreak underlying models.
We may remove or restrict content, refuse or filter outputs, and suspend accounts that violate these rules. Rights-holders who believe their work has been infringed can contact us at hello@semioticmap.com and we will action valid takedown requests. Repeat infringers will have their access terminated.
6. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
7. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by the Seller and protected by applicable IP laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms and your selected plan. You retain ownership of the content you create using the Service.
8. Payment, subscriptions, and billing
Our order process and all payments are handled by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing and handles returns. Payment, subscription renewal, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Paid subscriptions renew automatically until cancelled.
9. Refunds
Please see our Refund Policy.
10. Service availability
We work to keep the Service available and accurate, but we do not guarantee uninterrupted, error-free, or secure operation. The Service is provided “as is” and, to the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Suspension and termination
We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time and cancel your subscription via the customer portal. On termination, your access ends and we may delete your stored content after a reasonable export window.
12. Liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the twelve months immediately preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion would be unlawful.
13. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service in breach of these Terms, or your violation of applicable law.
14. Changes
We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after the changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the Seller's country of residence, without regard to conflict of laws principles. The courts of that jurisdiction have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections in your country of residence.
